Probate Court

The Lincoln Probate Court holds its sessions on the fourth Monday of each month at 8:45 am.

Probate Court has jurisdiction over the following types of cases:

  • Decedent's estates:  this includes persons who have died with a Will (testate) or those without one (intestate).
  • Adult Guardianships, either of the person, estate, or both.
  • Minor Guardianships, either of the person, estate, or both.
  • Adult Adoptions
  • Name Changes

  • Certification:  $3.00 + $1.50 per page
  • Certificate of Appointment:  $5.00
  • Copy of Change of Name Decree:  $5.00

  • Voluntary Informal Petitions:  $39.00
  • Affidavit of Complete Administration:  $39.00
  • First and Final Accounting:  $99.00
  • All other Petitions (RIGL 33-22.21):  $34.00

Inventory Tax:  

1% of the Personal Estate less than the $30.00 filing fee which was paid when the petition was filed.

  • Minimum Inventory Tax:  $30.00
  • Maximum Inventory Tax:  $1,470.00
